APW PREPAID ACCOUNT TERMS & CONDITIONS

These Terms & Conditions (“Terms”) govern the use of APW prepaid accounts and associated cards (“Card”) issued by APW Fuel Group (“APW”) to account holders (“Cardholder”). By activating or using an APW Card or account, the Cardholder agrees to be bound by these Terms in full.

Important Notice: This account operates strictly on a prepaid basis. No credit is offered, and no extension of credit will be provided under any circumstances. All transactions are limited to the available cleared account balance. Transactions will be automatically declined if sufficient funds are not available.

 

 

SECTION 1: CORE TERMS (FINANCIAL & LEGAL)

1. Prepaid Account Operation

This account functions exclusively on a prepaid model. APW Fuel Group does not extend credit, and no credit facilities will be provided under any circumstances. All transactions are contingent upon the availability of cleared funds in the account. Transactions will be automatically declined if the account balance is insufficient. Under no circumstances will the account be permitted to incur a negative balance.

2. Payments and Funding

Funds must be successfully received, cleared, and allocated to the Cardholder’s account before they become available for use. APW Fuel Group bears no responsibility for delays in payment processing, including those related to bank transfers or card processing networks. Certain payment methods may be subject to applicable surcharges.

3. Account Limits and Controls

Account balances cannot be exceeded. APW Fuel Group staff are not authorised to override account limits or approve transactions that exceed available funds. If an account balance is insufficient, Cardholders must complete a top-up transaction before further use.

4. System of Record

APW Fuel Group’s internal systems, including its portal and operational databases, serve as the definitive system of record for all account balances, transactions, and account statuses.

5. Account Suspension and Termination

APW Fuel Group reserves the right to suspend or restrict account access, or terminate an account, for operational, risk management, or compliance reasons, including but not limited to:

* Suspected fraudulent or unauthorised activity.

* Breach of these Terms by the Cardholder.

* The account balance remains at zero for a period exceeding four (4) consecutive months.

* Failure to complete required account actions within specified timeframes.

* Unresolved payment or system-related issues.

6. Refunds on Account Balances

Unused prepaid balances may be eligible for a refund upon account closure, subject to:

* Successful identity verification and confirmation of authorised account holder details.

* Completion of any pending transactions.

* Adherence to any applicable processing requirements.

APW Fuel Group reserves the right to offset any outstanding fees, charges, disputed transactions, or amounts owing against the refundable balance before processing any refund.

7. Data Usage and Privacy

Customer information provided to APW Fuel Group will be utilised solely for the purposes of assessing, managing, operating, supporting, and administering the prepaid account, associated cards, portal access, payments, transactions, and related customer communications. All data handling will comply with applicable privacy laws.

8. Amendments to Terms

APW Fuel Group may amend these Terms from time to time. Updated Terms will be made available via the APW portal or through other designated customer communication channels. Continued use of the account or any issued Card following notification of updated Terms constitutes the Cardholder’s acceptance of those revised Terms.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising from these Terms or the use of the Card shall be subject to the exclusive jurisdiction of the courts of New South Wales.

SECTION 2: CARD & ACCOUNT OPERATING RULES

10. Card Ownership and Authorised Use

Cards issued by APW Fuel Group remain the property of APW at all times. Cards are issued exclusively for use by authorised individuals designated by the Cardholder. Cards are not transferable to any third party outside of the Cardholder’s authorised employees or drivers.

11. Cardholder Responsibilities

The Cardholder assumes full responsibility for all transactions conducted using issued Cards and for their proper safekeeping. Key responsibilities include:

* Maintaining a sufficient account balance at all times.

* Regularly monitoring all transactions and reviewing account statements via the APW portal.

* Ensuring Cards are stored securely and used only by authorised drivers or employees.

* Ensuring all authorised users comply with these Terms and account conditions.

* Maintaining the confidentiality of PINs and not sharing them with unauthorised persons.

* Safeguarding all Cards and account access credentials.

* Promptly reporting any lost, stolen, or compromised Cards to APW Fuel Group.

The APW portal serves as the primary interface for managing all account activity, including balances, transactions, and card controls.

12. Reporting Lost or Stolen Cards

It is the sole responsibility of the Cardholder to report a lost or stolen Card to APW Fuel Group as soon as practicably possible after becoming aware of the loss or theft. Notification must be made via one of the following methods:

APW Fuel Group will undertake reasonable steps to block the Card upon receipt of a valid report. However, APW accepts no liability for any transactions processed before the Card has been successfully deactivated within its system.

13. Liability for Transactions

The Cardholder is responsible for all transactions until the affected Card is successfully deactivated. This includes, but is not limited to, transactions made:

* Prior to a lost or stolen Card being reported to APW Fuel Group.

* As a direct result of the Cardholder’s failure to maintain PIN confidentiality.

* By an employee, driver, or any third party with access to the Card or its PIN.

* After standard business hours, the report could not be actioned until the subsequent business day.

The Cardholder remains solely responsible for all transactions recorded against their account until APW Fuel Group confirms the successful deactivation of the Card.

14. PIN Security

A unique 4-digit Personal Identification Number (PIN) is assigned to each Card during its activation process. The Cardholder is responsible for:

* Selecting a PIN that is not easily guessable (e.g., avoiding sequences like 0000 or 1234).

* Refraining from writing the PIN on or near the Card.

* Not disclosing the PIN to any person who is not an authorised user of the Card.

If a PIN is suspected of being compromised, the Cardholder must immediately update it via the APW portal and report the Card as potentially at risk to APW Fuel Group.

15. Account Monitoring and Discrepancies

Cardholders are required to regularly review their transactions and report any discrepancies within thirty (30) days of the transaction appearing in the APW portal or statement. Failure to report discrepancies within this specified timeframe may limit the Cardholder’s ability to dispute such transactions.

16. Replacement Cards

Replacement Cards may be issued upon request following a loss, theft, or damage to an existing Card. APW Fuel Group reserves the right to levy a card replacement fee. Replacement Cards will be dispatched to the registered business address. The Cardholder is responsible for activating the replacement Card and accepting these Terms prior to its use.

17. Prepaid Operation Confirmation

Transactions will only be authorised when sufficient cleared funds are available in the account. It is the Cardholder’s responsibility to ensure adequate funds are maintained to meet their operational requirements.
